Scope

These General Terms and Conditions (AGB) apply to all services provided by Firouz Mostovfi, KidsKultur c/o Bronco, Hufelandstr. 13, 10308 Berlin, Phone: +49 30 83229995, Mobile: +49 160 5488717, Email: info@kidskultur.com (hereinafter "KidsKultur"). By booking a service, the customer agrees to these AGB.

Service Description

KidsKultur offers events with a cultural focus, visits to culturally relevant institutions, private and public facilities, and workshops for adults and professionals in the fields of education and childcare. Additionally, KidsKultur organizes day trips to cultural and educational destinations. Services are provided by Firouz Mostovfi, a state-certified educator, designer, and workshop leader. Certain events may be led or accompanied by freelance professionals due to their specific focus.

Contract Partners and Conclusion of Contract

KidsKultur’s services are offered to:

Parents and guardians booking for their children aged 5 to 8 years.
Teachers and educators from schools and daycare centers (both domestic and international). Contracts are exclusively concluded digitally and online. A binding contract between the customer and KidsKultur is formed upon the completion of the booking.
Compensation
Compensation is structured as follows:

For bookings by private individuals (parents/adults), payment is made via bank transfer or PayPal.
For workshops for adults and professionals, compensation is on a fee basis and invoiced.
Subscriptions and Recurring Payments
There are currently no subscriptions or recurring payments. Such an offering is planned for the future.

Cancellation Policy

Bookings can be canceled free of charge up to 24 hours before the event. In case of cancellation after this period, the full amount is due.

Usage and Image Rights

No usage rights are transferred to the customer.

All activities at KidsKultur are documented through photographs and videos. The legal guardians of the participating children give their consent to the use of images and videos for evaluation, archiving, and social media content by KidsKultur. This consent can be revoked at any time. Before any publication, parents will be contacted, a selection of images and videos will be presented to them, and separate consent for publication will be requested.

Changes to Services
Subsequent changes to services are possible upon agreement. Details regarding any additional costs must be clarified individually.

Liability

KidsKultur is liable for damages only in cases of intent or gross negligence. Further liability, especially for minor negligence, is excluded unless it involves the breach of essential contractual obligations. The use of public transportation, including long-distance trains such as ICE, is part of the service offered for visits to cultural institutions and events. KidsKultur is not liable for accidents or damages that occur during the use of these transportation services by third parties.

In collaborations with schools and daycare centers, liability for the execution of the event and supervision of children lies with the respective institutions, not with KidsKultur. Liability for the safe transport and well-being of children on the way to the agreed drop-off location (e.g., meeting point or event venue) lies solely with the parents or guardians. KidsKultur assumes responsibility for the children’s supervision only after they have been handed over at the agreed drop-off location.

KidsKultur is not liable for the children's property or any items they bring with them. It is recommended not to bring valuable or fragile items.

Parents can track their children during KidsKultur activities via GPS or WhatsApp location to stay informed about their whereabouts at all times.

Jurisdiction

The place of jurisdiction for all disputes arising from the contractual relationship between the customer and KidsKultur is Berlin.
